Item 3.01
Notice of Delisting or Failure to Satisfy a Continued Listing Rule or Standard; Transfer of Listing.

On November 21, 2008, the Board of Trustees (the “Board of Trustees”) of the Ziegler Exchange Traded Trust (the “Trust”) , approved the liquidation of the NYSE Arca Tech 100 ETF (the “Fund”) . The Board of Trustees determined that closing the Fund was in the best interests of the Fund and its shareholders because the Fund has not gathered sufficient assets to continue its business and operations in an economically viable manner. In connection with the Fund’s liquidation, the Board of Trustees also approved on November 21, 2008 to voluntarily delist the Fund’s shares of beneficial interest listed and traded on NYSE Arca. The Fund expects that its shares will cease trading on or about December 15, 2008. The Trust’s press release announcing the liquidation is attached as Exhibit 99.1 and is incorporated herein by reference.
