The New Zealand Commerce Commission recommended Wednesday regulation of mobile termination access services in a preliminary report.

In a draft reconsideration report, the Commerce Commission said its preliminary view is to recommend the Minister for Communications and Information Technology regulate mobile termination access services, and not accept undertakings from Telecom Corp. of New Zealand Ltd. (NZT, TEL.NZ) and Vodafone Group PLC's (VOD, VOD.LN) Vodafone New Zealand in lieu of regulation.

The Commerce Commission said, in the light of a new product offered by Vodafone, the mobile termination rates offered by the two companies "will not address the competition concerns identified by the Commission."

The Commerce Commission said its preliminary view is that if cost-based mobile termination rates were put in place, "then all mobile operators would be able to vigorously compete in the retail market and provide consumers with competitive and innovative calling products."

The Commerce Commission is inviting submissions on its draft reconsideration report. All submissions must be filed by May 19. It expects to deliver its final report in early June.
