CHAPTER I INVESTIGATION UNDER THE COMPETITION ACT 1998
The Board of Wiseman announces that it received notification on 14th August 2003
from the OFT that it had reopened its investigation into the supply of fresh
processed milk to middle ground retailers in Scotland under Chapter I of the
Competition Act 1998. The OFT has advised that Wiseman is one of the
undertakings subject to the investigation.
The initial Chapter I investigation commenced in June 2000 and concluded on 9th
October 2002. During the entire period of that investigation, and since that
time, no allegations have been put to, or questions asked of Wiseman.
Chairman Alan Wiseman said, " We have always maintained that there is no case to
answer and we are obviously surprised and disappointed that the case has been
reopened. The Company has been subject to three investigations by the OFT and
Competition Commission since 2000 with no action taken against the Company.
"During this same period we have made great progress opening our flagship dairy
at Droitwich Spa, which provides the platform for our continued growth. We will
not allow this reopened investigation to distract us from running the business.
"We will of course co-operate fully with the OFT to allow them to reach a speedy
resolution of their investigation. "
Notes to Editor:
1. *On 22nd December 2000 the Competition Commission published its report into
the supply of milk in Scotland which resulted in no action being taken
against the Company.
2. *On 9th August 2002 Wiseman received confirmation the OFT had closed its
investigation under Chapter II of the Competition Act 1998 and that no
action was being taken against the Company.
3. *On 9th October 2002 Wiseman received confirmation the OFT had closed its
initial investigation under Chapter I of the Competition Act 1998 and that
no action was being taken against the Company.
